Fit Street National School of Health & Performance Sciences

"Company", "We", "Us" or "Our" shall mean Ball Street Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at B-10/128, Kalyani, Nadia, West Bengal – 741235, operating educational, health, nutrition, wellness, fitness, digital learning and related services under the brand Fit Street National School of Health & Performance Sciences and its associated platforms.

By enrolling in any course or using our services, you agree to be legally bound by these Terms.

Terms & Conditions

DEFINITIONS & INTERPRETATION

1.1 "Institution"

"Institution" refers to Fit Street National School of Health & Performance Sciences, an educational initiative owned and operated by Ball Street Private Limited.

1.2 "Website"

"Website" means all official websites, portals, mobile applications, learning management systems (LMS), student dashboards, digital platforms, microsites and domains owned, operated or authorized by the Company, including but not limited to:

  • www.fitstreetschool.com
  • www.fitstreet.in

and any future official digital platforms introduced by the Company.

1.3 "User"

A "User" means any individual accessing or using the Website or any services provided by the Institution, irrespective of whether such individual is registered or enrolled.

1.4 "Student"

A "Student" means any individual who has successfully enrolled in any course, certification, workshop, webinar, internship, mentorship program, assessment, educational service or any other learning program offered by the Institution.

1.5 "Parent / Guardian"

Where a Student is below the age required to independently enter into a binding contract under applicable law, "Parent" or "Guardian" shall mean the lawful parent or legal guardian who has provided consent for such Student's enrollment.

1.6 "Course"

"Course" means any educational, certification, diploma, training program, workshop, seminar, webinar, internship, bootcamp, mentorship, awareness initiative, online class, offline class or any other academic or professional learning program offered by the Institution.

1.7 "Digital Content"

"Digital Content" includes but is not limited to:

  • Video lectures
  • Recorded sessions
  • Live classes
  • Study material
  • PDFs
  • Notes
  • Assignments
  • Assessments
  • Question banks
  • Presentations
  • Images
  • Graphics
  • Software
  • Downloadable resources
  • Learning tools
  • Audio recordings
  • Course documentation

made available by the Company through any medium.

1.8 "Certification"

"Certification" means a certificate issued by the Institution upon successful completion of applicable course requirements, assessments, attendance requirements and other eligibility criteria determined by the Institution.

Issuance of a certificate does not constitute government licensing, statutory registration or authorization to practice any regulated profession unless expressly stated.

1.9 "Placement Assistance"

"Placement Assistance" refers to career support services offered by the Institution, which may include profile creation, profile verification, profile activation, profile visibility on Fitstreet.in, career guidance, interview assistance, employer introductions, networking opportunities or any other placement-related support as determined by the Institution.

Placement Assistance shall not be interpreted as:

  • Guaranteed employment;
  • Guaranteed interviews;
  • Guaranteed client acquisition;
  • Guaranteed bookings;
  • Guaranteed internships;
  • Guaranteed projects;
  • Guaranteed earnings;
  • Guaranteed business opportunities; or
  • Guaranteed income of any nature.

1.10 "Fit Street Platform"

"Fit Street Platform" means the proprietary technology platform owned and operated by Ball Street Private Limited through Fitstreet.in, where eligible professionals, trainers, nutritionists and other approved users may create professional profiles for visibility to prospective clients.

The platform functions on a marketplace and demand-based model, wherein client enquiries, profile visibility, trainer selection and bookings depend upon multiple commercial and market-driven factors.

1.11 "Profile Listing"

"Profile Listing" means activation and display of an eligible user's professional profile on the Fit Street Platform after completion of applicable eligibility requirements.

A Profile Listing shall not be construed as a guarantee of:

  • Client enquiries;
  • Personal training sessions;
  • Employment;
  • Projects;
  • Bookings;
  • Revenue;
  • Business generation; or
  • Income.

1.12 "Fees"

"Fees" include registration fees, admission fees, tuition fees, examination fees, certification fees, subscription charges, technology charges, processing charges and any other amounts payable to the Institution.

1.13 "Services"

"Services" include all educational, training, certification, mentoring, placement assistance, profile listing, digital learning, career support, awareness initiatives and any other services provided by the Institution from time to time.

1.14 "Business Day"

A Business Day means any day other than a Sunday or a public holiday on which the Company's administrative offices remain operational.

1.15 "Applicable Law"

"Applicable Law" means all laws, rules, regulations, notifications, circulars, judicial precedents and statutory provisions applicable within the Republic of India, including any amendments made thereto from time to time.

1.16 "Intellectual Property"

"Intellectual Property" includes all copyrights, trademarks, service marks, trade names, logos, course content, educational material, software, source code, videos, graphics, designs, databases, documentation, proprietary methodologies, study material and all other intellectual property owned or licensed by the Company.

1.17 "Terms"

"Terms" means these Terms & Conditions together with all policies, guidelines, notices, disclaimers, privacy policy, refund policy, placement policy and any amendments published by the Company from time to time.

1.18 Interpretation

Unless the context otherwise requires:

  • Words importing the singular shall include the plural and vice versa.
  • Headings are inserted for convenience only and shall not affect interpretation.
  • References to statutes shall include amendments, re-enactments and replacements thereof.
  • Any reference to one gender shall include all genders.
  • References to "including" shall mean "including without limitation."
  • In the event of any ambiguity, the interpretation of these Terms by Ball Street Private Limited shall prevail to the extent permitted under applicable law.

ACCEPTANCE OF TERMS & USER AGREEMENT

2.1 Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between the User and Ball Street Private Limited, operating under the brand Fit Street National School of Health & Performance Sciences ("Institution").

By accessing, browsing, registering on, enrolling in, purchasing, subscribing to, downloading, or otherwise using any website, application, learning platform, course, certification program, workshop, seminar, webinar, internship, digital content, educational service, placement assistance, or any other service offered by the Institution, the User acknowledges that they have read, understood, and voluntarily agreed to be legally bound by these Terms, the Privacy Policy, and all other applicable policies published by the Institution from time to time.

If the User does not agree with any part of these Terms, the User must immediately discontinue the use of the Institution's Website, platforms, applications, and services.

2.2 Legally Binding Agreement

These Terms shall constitute a valid and enforceable electronic agreement under the applicable laws of India and shall have the same force and effect as a written agreement executed by the Parties.

The User acknowledges that acceptance of these Terms may occur electronically, including but not limited to:

  • Clicking "I Agree", "Accept", "Register", "Enroll", "Proceed", "Purchase", or similar buttons;
  • Completing any online registration or enrollment process;
  • Making payment for any course or service;
  • Accessing or continuing to use the Institution's Website or services;
  • Participating in online or offline classes, workshops, events, examinations, or assessments.

Such actions shall constitute unconditional acceptance of these Terms.

2.3 Eligibility

The User represents and warrants that:

  • They are legally competent to enter into a binding contract under applicable law; or
  • Where the User is a minor or otherwise lacks legal capacity, enrollment and acceptance of these Terms have been completed by a lawful parent or legal guardian acting on the User's behalf.

The Institution reserves the right to seek proof of age, identity, or parental authorization at any time.

Submission of false, misleading, or incomplete information may result in suspension or cancellation of admission without any liability upon the Institution.

2.4 Authority to Accept

Where enrolment, registration, or payment is completed by a parent, guardian, employer, educational institution, organization, or any other authorized person on behalf of a User, such person confirms that they possess the legal authority to bind the User to these Terms.

The Institution shall not be responsible for any dispute arising between the User and such person regarding authority or consent.

2.5 Applicability

These Terms apply to all individuals interacting with the Institution, including but not limited to:

  • Students;
  • Parents or legal guardians;
  • Trainers;
  • Nutritionists;
  • Professionals;
  • Website visitors;
  • Applicants;
  • Internship participants;
  • Workshop participants;
  • Webinar attendees;
  • Certification candidates;
  • Business partners;
  • Recruiters;
  • Employers;
  • Visitors using the Website or digital platforms.

2.6 Continuous Acceptance

The User acknowledges that continued access to or use of the Institution's services after any modification, update, or revision of these Terms shall constitute acceptance of such revised Terms.

The Institution reserves the right to modify, amend, update, replace, or discontinue any portion of these Terms at any time without prior notice, unless otherwise required under applicable law.

The latest version published on the Institution's official Website shall prevail.

2.7 No Waiver

Failure or delay by the Institution in exercising any right, remedy, or provision contained in these Terms shall not constitute a waiver of such right or prevent the Institution from exercising the same at any subsequent time.

2.8 Electronic Communications

The User consents to receive communications from the Institution electronically through email, SMS, WhatsApp, telephone calls, mobile notifications, student dashboards, or any other communication medium provided during registration or subsequently updated by the User.

All such communications shall be deemed valid and legally sufficient for the purposes of providing notices, announcements, academic information, payment reminders, examination details, placement-related communication, policy updates, and other official correspondence.

2.9 Independent Decision

The User acknowledges that enrollment into any course or program has been undertaken voluntarily after independent evaluation of the course details, curriculum, fees, eligibility criteria, placement support, certification process, and other relevant information.

The User confirms that they have not relied upon any oral statement, promotional material, advertisement, social media content, verbal assurance, or representation not expressly incorporated into these Terms or any written agreement executed by the Institution.

2.10 Entire Understanding

These Terms, together with the Institution's Privacy Policy, Refund Policy, Placement Policy, Code of Conduct, and any written admission documents issued by the Institution, constitute the complete understanding between the Institution and the User concerning the use of the Institution's services.

Any verbal assurance, informal communication, social media interaction, sales discussion, promotional statement, or prior correspondence that is inconsistent with these Terms shall not create any legally binding obligation upon the Institution unless expressly confirmed in writing by an authorized representative of Ball Street Private Limited.

2.11 Reservation of Rights

The Institution reserves the right, at its sole discretion and subject to applicable law, to:

  • Refuse or cancel any admission or registration;
  • Suspend or terminate access to any service;
  • Verify eligibility and identity;
  • Modify courses, schedules, faculty, curriculum, assessments, certifications, or platform features;
  • Investigate misuse of the Website or services;
  • Take appropriate legal or disciplinary action for any violation of these Terms.

The exercise or non-exercise of any such right shall not prejudice any other rights or remedies available to the Institution under applicable law.

ELIGIBILITY, ADMISSIONS & ENROLLMENT

3.1 Eligibility for Enrollment

Enrollment into any course, certification, diploma, workshop, internship, seminar, webinar, awareness program, mentorship, or educational service offered by the Institution shall be subject to the eligibility criteria prescribed for the respective program.

The Institution reserves the absolute right to determine, modify, relax, or revise eligibility requirements from time to time without prior notice.

Eligibility requirements may include, but are not limited to:

  • Minimum educational qualifications;
  • Minimum age requirements (where applicable);
  • Professional qualifications;
  • Relevant work experience;
  • Skill assessments;
  • Interviews;
  • Entrance tests;
  • Document verification;
  • Any other criteria determined by the Institution.

Meeting the minimum eligibility criteria shall not automatically entitle an applicant to admission.

3.2 Programs for Minors

Certain awareness programs, workshops, school initiatives, sports nutrition programs, wellness education sessions, or child-specific educational programs may be offered for participants below the age of majority.

Enrollment of any minor shall be permitted only through a lawful parent or legal guardian.

The parent or legal guardian represents and warrants that:

  • They have lawful authority to enroll the minor;
  • The information submitted is accurate;
  • They have read and accepted these Terms & Conditions on behalf of the minor.

The Institution reserves the right to require proof of guardianship or identity at any stage.

3.3 Admission Process

Admission shall be considered complete only after all of the following have been satisfied, wherever applicable:

  • Submission of the prescribed application;
  • Successful verification of eligibility;
  • Submission of required documents;
  • Acceptance of these Terms & Conditions;
  • Payment of applicable fees;
  • Confirmation issued by the Institution.

Until a written confirmation of admission is issued by the Institution, no applicant shall be deemed to have acquired any right to admission.

3.4 Verification of Information

The Institution may verify any information, qualification, certificate, experience, identity proof, address proof, employment record, educational qualification, or supporting document submitted by an applicant.

The Institution reserves the right to seek additional documentation or clarification at any time.

Submission of false, forged, misleading, incomplete, or fabricated information may result in:

  • Rejection of admission;
  • Cancellation of enrollment;
  • Withholding of certification;
  • Suspension from the course;
  • Permanent blacklisting from future programs; and/or
  • Appropriate legal action, wherever applicable.

3.5 Right to Refuse Admission

The Institution reserves the absolute discretion to refuse, reject, defer, suspend, or cancel any application or admission without assigning any reason, subject to applicable law.

Such decision may be taken for reasons including, but not limited to:

  • Failure to satisfy eligibility criteria;
  • Submission of incorrect information;
  • Misconduct;
  • Security concerns;
  • Violation of institutional policies;
  • Operational limitations;
  • Capacity constraints; or
  • Any other reason considered appropriate by the Institution.

3.6 Admission Confirmation

Admission shall be deemed confirmed only upon issuance of an official communication from the Institution through its authorized communication channels.

Payment of fees alone shall not constitute confirmation of admission.

The Institution reserves the right to cancel or decline admission where verification remains incomplete or eligibility requirements are not satisfied.

3.7 Batch Allocation

Allocation of a particular batch, faculty member, mentor, schedule, classroom, online session, examination date, practical session, or training location shall remain solely at the discretion of the Institution.

The Institution reserves the right to:

  • Change batches;
  • Merge batches;
  • Reschedule classes;
  • Replace faculty;
  • Modify academic calendars;
  • Alter delivery mode (online/offline/hybrid);
  • Change class timings or locations.

Such changes shall not constitute grounds for refund or compensation.

3.8 Waiting List

Where admissions exceed available capacity, applicants may be placed on a waiting list.

Placement on a waiting list does not create any legal entitlement to admission.

3.9 Documents Required

Applicants may be required to submit one or more of the following documents:

  • Government-issued identity proof;
  • Passport-size photographs;
  • Educational qualification certificates;
  • Experience certificates;
  • Parent/Guardian consent (where applicable);
  • Medical declaration (where applicable);
  • Address proof;
  • Any other document prescribed by the Institution.

Failure to submit the required documents within the prescribed timeline may result in cancellation of admission.

3.10 Change of Personal Information

The Student shall promptly notify the Institution of any change in:

  • Name;
  • Address;
  • Email address;
  • Mobile number;
  • Educational qualifications;
  • Emergency contact details;
  • Identity documents.

The Institution shall not be responsible for any communication failure arising from outdated or incorrect information provided by the Student.

3.11 Admission Cancellation by Applicant

Any request for cancellation of admission must be made in writing.

Such request shall be governed exclusively by the Institution's Refund and Cancellation Policy and other applicable policies.

Submission of a cancellation request shall not automatically entitle the applicant to any refund, transfer, deferment, or compensation.

3.12 Admission Cancellation by the Institution

The Institution reserves the right to suspend or cancel admission at any stage if:

  • Eligibility criteria are not fulfilled;
  • Fraudulent documents are discovered;
  • Fees remain unpaid;
  • The Student engages in misconduct;
  • Institutional policies are violated;
  • The Student's conduct adversely affects other students, faculty, staff, or the Institution;
  • Continued enrollment is considered inappropriate in the Institution's reasonable opinion.

Cancellation under this clause shall be without prejudice to any other legal rights available to the Institution.

3.13 No Guarantee of Admission to Future Programs

Enrollment in one course or certification shall not create any automatic right or preference for admission into any future course, certification, internship, placement initiative, advanced program, scholarship, or academic offering.

Each application shall be evaluated independently.

3.14 Reservation of Academic Decisions

All academic and administrative decisions relating to:

  • Admissions;
  • Eligibility;
  • Batch allocation;
  • Curriculum;
  • Faculty assignment;
  • Assessments;
  • Attendance;
  • Certification;
  • Placement assistance; and
  • Student discipline

shall remain solely within the discretion of the Institution, subject to applicable law.

3.15 No Waiver of Institutional Rights

Granting admission, accepting fees, issuing provisional confirmations, permitting attendance, or allowing access to the learning platform shall not restrict the Institution's right to subsequently verify eligibility, cancel admission, or take disciplinary action in accordance with these Terms.

3.16 Reservation of Rights

The Institution reserves the right to modify, suspend, discontinue, introduce, or revise any admission process, eligibility requirement, documentation requirement, enrollment procedure, or academic policy at any time to ensure regulatory compliance, operational efficiency, and academic standards.

Any such modification shall apply prospectively unless otherwise required by applicable law.

COURSE FEES & PAYMENT TERMS

4.1 Fee Structure

The fee applicable to each course, certification, diploma, workshop, internship, seminar, webinar, subscription, assessment, examination, profile activation, or any other educational service shall be as notified by the Institution from time to time.

The Institution reserves the right to revise, modify, introduce, or discontinue any fee structure at its sole discretion. Any revision shall apply prospectively unless otherwise communicated.

4.2 Payment Obligation

Enrollment in any course constitutes a binding financial commitment by the Student (or Parent/Guardian, where applicable) to pay all applicable fees in accordance with the payment plan selected at the time of admission.

The Student shall remain liable for all fees payable under the selected enrollment plan irrespective of:

  • Course attendance;
  • Partial participation;
  • Non-utilization of services;
  • Change of personal circumstances;
  • Employment commitments;
  • Relocation;
  • Technical limitations on the Student's side; or
  • Voluntary discontinuation of the course.

4.3 Payment Methods

Payments may be made only through payment methods approved by the Institution, including but not limited to:

  • UPI
  • Debit Cards
  • Credit Cards
  • Net Banking
  • Digital Wallets
  • Bank Transfers (NEFT/RTGS/IMPS)
  • EMI Facilities
  • Approved Payment Gateways
  • Other officially notified payment methods

The Institution shall not be responsible for payments made through unauthorized persons, unofficial bank accounts, third-party intermediaries, or fraudulent payment channels.

4.4 Payment Confirmation

Admission shall not be deemed complete until the payment has been successfully received, verified, and acknowledged by the Institution.

In the event of payment gateway failure, banking delays, transaction reversal, chargeback, failed authorization, or technical errors, the Institution reserves the right to withhold access until successful confirmation of payment.

4.5 Taxes

All fees are exclusive of applicable taxes unless expressly stated otherwise.

The Student shall be responsible for payment of all applicable taxes, duties, levies, cess, or statutory charges imposed by any governmental authority.

4.6 Instalment Plans

Where the Institution permits payment through instalments or EMI facilities:

  • Each instalment shall become due on the prescribed date.
  • Delay in one instalment shall constitute a default.
  • The Institution may suspend access to classes, examinations, certifications, learning materials, profile activation, placement assistance, or other services until overdue payments are cleared.
  • Approval of instalment facilities shall remain solely at the discretion of the Institution.

4.7 Default in Payment

If any fee remains unpaid beyond the prescribed due date, the Institution may, without prejudice to any other legal rights:

  • Suspend access to the learning platform;
  • Restrict attendance in online or offline sessions;
  • Withhold examination access;
  • Withhold certification;
  • Suspend profile activation on FitStreet.in;
  • Suspend placement assistance;
  • Recover outstanding dues through lawful means;
  • Initiate legal proceedings where necessary.

Such suspension shall not relieve the Student from the obligation to pay outstanding dues.

4.8 Promotional Offers & Scholarships

The Institution may, at its sole discretion, provide scholarships, discounts, promotional pricing, referral benefits, corporate pricing, seasonal offers, or coupon codes.

Such offers are discretionary, may be modified or withdrawn without prior notice, shall not create any continuing entitlement, and cannot ordinarily be combined unless specifically permitted by the Institution.

4.9 Third-Party Financing

Where the Student chooses financing, education loans, EMI providers, BNPL services, or any third-party financial institution, the agreement shall remain solely between the Student and such financing provider.

The Institution shall not be responsible for financing approvals, loan terms, repayment obligations, interest charges, penalties, or disputes arising between the Student and such provider.

4.10 Receipts

Official payment receipts shall be issued by the Institution through its authorized systems. Students are advised to retain all payment confirmations and receipts for future reference.

The Institution may refuse to recognize payments unsupported by verifiable transaction records.

4.11 Currency

Unless expressly stated otherwise, all fees shall be payable in Indian Rupees (INR). For international payments, currency conversion charges, foreign exchange fluctuations, banking charges, and intermediary fees shall be borne by the payer.

4.12 No Set-Off or Deduction

The Student shall not withhold, deduct, adjust, or set off any fees payable against any alleged claim, grievance, compensation, damages, or dispute unless required by a final order of a competent court or authority.

4.13 Fee Revision

The Institution reserves the right to revise fees for new admissions, future batches, new certifications, additional services, or platform features. Such revisions shall not ordinarily affect fees already paid by existing Students unless additional optional services are availed.

4.14 Additional Charges

Certain services may attract separate charges, including but not limited to: re-examinations, duplicate certificates, certificate verification, international shipping, identity card replacement, transcript issuance, additional workshops, special practical sessions, profile verification, or premium platform features.

4.15 Payment Disputes

Any payment-related dispute shall be communicated to the Institution in writing within 7 (Seven) Business Days from the date of the disputed transaction. Failure to raise such dispute within the prescribed period may result in the transaction being treated as accepted, subject to applicable law.

4.16 Chargebacks and Payment Reversals

If a payment is reversed, disputed, or subjected to a chargeback by the payer or issuing financial institution after access to the course or services has been granted, the Institution reserves the right to:

  • Suspend or terminate access to the course or platform;
  • Recover the outstanding amount along with applicable transaction costs;
  • Withhold certificates or placement-related services until resolution of the payment dispute; and
  • Initiate appropriate legal or recovery proceedings where warranted.

4.17 No Guarantee Based on Fee Payment

Payment of course fees or any other charges shall not, by itself, guarantee admission, successful completion of the course, certification, placement, employment, client acquisition, profile activation, or any specific academic, professional, or financial outcome. The Student must satisfy all eligibility criteria, academic requirements, conduct standards, and other conditions prescribed by the Institution.

4.18 Reservation of Rights

The Institution reserves the right to refuse, suspend, restrict, or discontinue any service in the event of non-payment, fraudulent transactions, unauthorized payment methods, breach of these Terms & Conditions, or any conduct that adversely affects the Institution or its operations, subject to applicable law.

NO REFUND, CANCELLATION & TRANSFER POLICY

5.1 General Policy

The Institution is committed to maintaining transparency and fairness in its admission and payment processes. Students and Users are advised to carefully review all course details, eligibility criteria, curriculum, fees, payment schedules, duration, certification requirements, placement assistance terms, and other relevant information before enrolling in any course or making any payment.

Enrollment into any course constitutes confirmation that the Student has independently evaluated the suitability of the program and has voluntarily chosen to enroll.

5.2 No Refund Policy

All payments made to the Institution are final and non-refundable.

Except where a refund is expressly required under applicable law or specifically approved in writing by the Institution, no refund, whether full or partial, shall be granted in respect of: registration fees, admission fees, tuition fees, course fees, certification fees, examination fees, subscription charges, technology fees, profile activation charges, placement assistance fees, workshops, seminars, webinars, internships, digital learning programs, study materials, any bundled educational services, or any other amount paid to the Institution.

5.3 Circumstances Where Refund Shall Not Be Granted

Without limiting the generality of Clause 5.2, refunds shall not be granted on account of:

  • Change of mind;
  • Personal reasons;
  • Financial constraints;
  • Employment commitments;
  • Relocation;
  • Medical reasons;
  • Family circumstances;
  • Inability to attend classes;
  • Non-utilization of course access;
  • Dissatisfaction with personal expectations;
  • Internet or device-related issues at the User's end;
  • Failure to complete assignments;
  • Failure to appear for examinations;
  • Failure to obtain certification;
  • Failure to obtain employment;
  • Failure to obtain clients;
  • Failure to receive trainer bookings;
  • Failure to earn any income;
  • Voluntary discontinuation of the course;
  • Suspension or termination resulting from violation of these Terms.

5.4 Digital Products and Learning Content

Upon activation of access to any digital learning platform, recorded lectures, downloadable resources, LMS, assessments, study material, or other digital content, the educational services shall be deemed to have commenced.

Accordingly, no refund shall be available merely because the Student has viewed only part of the content, completed only a few classes, not completed the course, or chosen not to continue learning.

5.5 Cancellation by Student

A Student may request cancellation of enrollment at any time by submitting a written request to the Institution.

Such cancellation shall only result in discontinuation of access to future services and shall not entitle the Student to any refund, credit, adjustment, waiver, or compensation, except where required by applicable law.

5.6 Cancellation by the Institution

The Institution reserves the right to cancel, suspend, defer, or terminate enrollment if: false information or forged documents are submitted, fees remain unpaid, academic misconduct is established, the Student violates the Code of Conduct, the Student engages in abusive, threatening, defamatory, discriminatory, unlawful, or disruptive conduct, the Student infringes the Institution's Intellectual Property Rights, or continued participation is considered detrimental to the Institution, faculty, staff, or other Students.

In such cases, the Institution may discontinue services without any obligation to refund fees already paid, subject to applicable law.

5.7 Batch Transfer

The Institution may, at its sole discretion, permit transfer of a Student to another batch, subject to: availability of seats, academic feasibility, administrative approval, and compliance with applicable policies. Approval of a batch transfer shall not constitute a refund or financial adjustment.

5.8 Course Transfer

Requests for transfer from one course to another may be considered solely at the discretion of the Institution.

If approved, administrative charges may apply, additional fees may be payable where the new course carries a higher fee, and previous payments shall not automatically transfer unless specifically approved in writing. The Institution shall have no obligation to approve any course transfer request.

5.9 Deferral of Admission

The Institution may, in exceptional circumstances and at its sole discretion, permit deferment of admission to a future batch. Grant of deferment is entirely discretionary, shall not create any legal entitlement, and may be subject to administrative charges, revised fees, or updated curriculum.

5.10 Promotional Offers

Fees paid under scholarships, discounts, promotional campaigns, referral offers, corporate partnerships, early-bird pricing, or special promotional schemes shall remain subject to this No Refund Policy unless expressly stated otherwise in writing.

5.11 Placement Assistance

Enrollment in any course offering Placement Assistance, Career Support, Profile Listing, or Profile Activation shall not entitle the Student to any refund merely because: no interview is received, no employer contacts the Student, no client booking occurs, no trainer assignment is received, no income is generated, or the Student is dissatisfied with market response. Placement Assistance constitutes a support service and not a guarantee of employment, clients, bookings, projects, earnings, or business opportunities.

5.12 FitStreet Platform

Where eligible Students receive profile activation or visibility on FitStreet.in, such activation shall be deemed to constitute substantial performance of the placement assistance component.

The Institution expressly clarifies that FitStreet.in operates as a technology-enabled marketplace based on market demand, user preferences, geographic availability, service quality, pricing, competition, and other commercial factors. Accordingly, the Institution does not guarantee: client enquiries, trainer bookings, personal training sessions, nutrition consultations, employment opportunities, projects, recurring business, revenue, earnings, or any specific financial outcome.

5.13 Third-Party Services

The Institution shall not be liable for cancellation, interruption, or failure of services provided by third-party vendors, payment gateways, technology providers, recruiters, employers, partner organizations, or marketplace users. Such events shall not constitute grounds for refund.

5.14 Force Majeure

No refund shall become payable solely because classes, examinations, workshops, or educational activities are postponed, rescheduled, modified, or delivered through alternative modes due to circumstances beyond the reasonable control of the Institution, including but not limited to: natural disasters, epidemics or pandemics, government restrictions, court orders, civil unrest, internet outages, power failures, cybersecurity incidents, technical failures, or force majeure events.

5.15 Exceptions

Nothing contained in this Section shall limit any non-waivable rights available to a Student under applicable law. Where any competent court, tribunal, or statutory authority directs the Institution to process a refund in accordance with applicable law, the Institution shall comply with such binding direction to the extent legally required.

5.16 Acknowledgement

By enrolling in any program, making any payment, or continuing to use the Institution's services, the Student expressly acknowledges and agrees that:

  • The Student has read and understood this No Refund, Cancellation & Transfer Policy;
  • The Student voluntarily accepts that fees paid are generally non-refundable;
  • The Student has enrolled after independent evaluation of the course and associated services; and
  • No oral assurance, advertisement, marketing communication, or statement made by any representative shall override this written policy unless expressly approved in writing by an authorized representative of Ball Street Private Limited.

COURSE ACCESS & LEARNING PLATFORM

6.1 Grant of Limited Access

Subject to successful enrollment, verification of payment, and continued compliance with these Terms & Conditions, the Institution grants the Student a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access the enrolled course and the Institution's learning platform solely for personal educational purposes. No ownership rights in any course, digital content, software, or educational material are transferred to the Student.

6.2 Access to Learning Platform

The Institution may provide access to one or more learning platforms, websites, mobile applications, student dashboards, Learning Management Systems (LMS), or any other digital platform operated or authorized by Ball Street Private Limited. Access to such platforms shall remain subject to successful admission, verification of payment, compliance with these Terms, and continued eligibility for the enrolled course. The Institution reserves the right to change, upgrade, migrate, replace, or discontinue any learning platform without prior notice.

6.3 Access Duration

Course access shall remain valid only for the duration specified by the Institution for the respective course. Unless expressly communicated otherwise, access shall automatically expire upon completion of the prescribed access period. The Institution shall have no obligation to extend access beyond the approved duration.

6.4 User Credentials

Students shall be solely responsible for maintaining the confidentiality of login credentials, passwords, OTPs, authentication codes, student IDs, and any other access credentials. The Student shall immediately notify the Institution if any unauthorized access or suspected security breach occurs. The Institution shall not be liable for any loss arising from the Student's failure to safeguard login credentials.

6.5 Single User License

Course access is granted exclusively to the enrolled Student. Students shall not: share login credentials, allow third parties to access the platform, use another person's account, create multiple unauthorized accounts, or permit simultaneous access from unauthorized users. The Institution may suspend or terminate access if unauthorized account sharing is detected.

6.6 Device Compatibility

The Student is solely responsible for arranging and maintaining internet connectivity, mobile devices, computers, laptops, browsers, operating systems, audio equipment, software updates, and power supply. The Institution does not guarantee compatibility with every device or browser configuration.

6.7 Platform Availability

While reasonable efforts shall be made to maintain uninterrupted services, the Institution does not warrant that the learning platform shall remain continuously available. Temporary interruptions may occur due to: scheduled maintenance, software updates, server maintenance, technical failures, cybersecurity incidents, internet outages, force majeure events, or third-party service interruptions. Such interruptions shall not entitle the Student to any refund, compensation, or extension unless expressly approved by the Institution.

6.8 Course Content Delivery

Educational content may be delivered through one or more formats, including: live online sessions, recorded lectures, offline classroom training, hybrid learning, assignments, assessments, reading materials, practical sessions, case studies, workshops, webinars, or guest lectures. The Institution reserves the right to modify the mode of delivery whenever reasonably required.

6.9 Course Updates

The Institution continuously improves its curriculum. Accordingly, it reserves the right to: update course content, modify syllabus, add or remove modules, replace faculty members, update study materials, change assessment patterns, introduce new technologies, or improve learning methodologies. Such modifications shall not constitute grounds for refund.

6.10 Recording of Sessions

The Institution may record live classes, workshops, webinars, doubt sessions, practical demonstrations, academic interactions, or online meetings. Such recordings may be used for: academic purposes, quality assurance, faculty training, student support, regulatory compliance, or internal administration. Students consent to such recording by participating in the session.

6.11 Student Restrictions

Students shall not, directly or indirectly: copy course content, download unauthorized material, screen record lectures, photograph course materials, record live classes without written permission, redistribute educational material, upload course content on YouTube or social media, share paid content with third parties, sell or commercially exploit any educational material, remove copyright notices, or attempt to reverse engineer any software or platform. Any such act may result in immediate suspension or termination and legal action.

6.12 Intellectual Property Protection

All course material, including but not limited to videos, notes, PDFs, presentations, graphics, assessments, question banks, course structures, learning methodologies, branding, logos, trademarks, software, audio, images, and AI-generated educational resources, remain the exclusive intellectual property of Ball Street Private Limited or its licensors. No rights are transferred to the Student except the limited access expressly granted under these Terms.

6.13 AI and Digital Tools

The Institution may utilize artificial intelligence, automation, analytics, adaptive learning technologies, and digital tools to improve educational delivery. The Institution does not guarantee that AI-generated outputs, recommendations, assessments, or educational suggestions shall be error-free or suitable for every individual. Students remain responsible for independently evaluating educational content before implementation.

6.14 Acceptable Use

Students shall use the learning platform only for lawful educational purposes. The Student shall not: upload viruses or malicious software, attempt unauthorized access, interfere with platform security, hack or bypass platform protections, use automated bots or scraping tools, damage platform functionality, harass faculty or other students, or post unlawful, abusive, defamatory, discriminatory, or offensive content.

6.15 Suspension of Access

The Institution may suspend, restrict, or terminate access without prior notice where the Student: violates these Terms, misuses the platform, shares login credentials, engages in academic misconduct, infringes intellectual property, defaults in payment obligations, or acts in a manner prejudicial to the Institution. Such suspension shall not affect the Institution's right to recover outstanding dues or pursue legal remedies.

6.16 Platform Improvements

The Institution reserves the right to introduce new features, remove obsolete features, modify user interface, improve security, integrate third-party technologies, or upgrade infrastructure. Students acknowledge that such improvements may occasionally require temporary service interruptions.

6.17 Data Backup

Students are advised to maintain copies of their own notes, assignments, projects, assessment submissions, and personal documents. The Institution shall not be responsible for loss of user-generated content resulting from technical failures beyond its reasonable control.

6.18 No Guaranteed Availability

The Institution shall not be liable for inability to access the platform arising from: Student's internet issues, device malfunction, browser incompatibility, ISP failures, power interruptions, government restrictions, cyber incidents, or force majeure events.

6.19 Reservation of Rights

The Institution reserves the absolute right, subject to applicable law, to: restrict access, modify learning platforms, upgrade infrastructure, suspend services, introduce additional security measures, revoke access for misuse, or protect its educational ecosystem, intellectual property, and digital infrastructure.

Nothing contained herein shall be construed as creating any perpetual right to access the Institution's learning platform or digital services.

ATTENDANCE, ASSESSMENTS & CERTIFICATION

7.1 Academic Requirements

The Institution is committed to maintaining high academic standards and professional integrity. Every Student shall actively participate in the learning process and comply with the academic requirements prescribed for the respective course, certification, diploma, workshop, internship, or educational program. Successful enrollment alone shall not entitle a Student to certification.

7.2 Attendance Requirements

Students are expected to maintain regular attendance in all scheduled academic activities, including but not limited to: Live Online Classes, Offline Classroom Sessions, Practical Sessions, Workshops, Webinars, Guest Lectures, Clinical Demonstrations, Mentorship Sessions, Assessments, or Internship Activities. The Institution reserves the right to prescribe minimum attendance requirements for any course or program.

Failure to satisfy the prescribed attendance requirement may result in: ineligibility to appear for examinations, ineligibility for practical assessments, delay in certification, requirement to repeat modules, or withholding of course completion status.

7.3 Attendance Recording

Attendance may be recorded through one or more methods, including: LMS attendance logs, platform login records, biometric systems, QR code attendance, classroom registers, faculty records, practical attendance records, or any other technology approved by the Institution. The attendance records maintained by the Institution shall ordinarily be treated as final unless an apparent administrative error is established.

7.4 Late Joining & Missed Sessions

Students joining after commencement of a batch or missing scheduled sessions shall be responsible for completing academic requirements. The Institution may, at its sole discretion, provide access to recorded sessions or alternative learning resources; however, it shall not be under any obligation to conduct additional classes or compensate for missed learning opportunities.

7.5 Assessments

The Institution may evaluate Students through one or more methods, including: online/offline examinations, assignments, practical demonstrations, case studies, viva voce, presentations, research submissions, projects, internal assessments, or skill evaluations. The format, duration, evaluation methodology, marking scheme, and passing criteria may differ across programs.

7.6 Assessment Standards

Students shall complete all assessments honestly, independently, and in accordance with the academic standards prescribed by the Institution. The Institution reserves the right to reject, invalidate, or cancel any assessment where academic misconduct is suspected.

7.7 Academic Integrity

Students shall not: copy assignments, plagiarize academic work, impersonate another candidate, use unauthorized assistance during examinations, submit AI-generated work as original without authorization, falsify assessment records, attempt to manipulate examination systems, or share examination materials with unauthorized persons. Any violation may result in: award of zero marks, cancellation of examination, suspension, cancellation of enrollment, withholding of certification, permanent debarment, or legal action.

7.8 Re-Assessment

The Institution may, at its sole discretion, permit re-examinations, supplementary assessments, re-submission of assignments, or practical re-evaluations. Such permissions may be subject to administrative approval, additional fees, availability of examination schedules, and compliance with academic policies. Approval shall not be automatic.

7.9 Evaluation Decisions

All evaluation, grading, moderation, academic review, and certification decisions taken by the Institution, faculty members, or examination committees shall be final and binding, except in the event of an apparent clerical or administrative error. The Institution shall not be obligated to entertain requests for re-evaluation unless specifically provided under its academic policy.

7.10 Certification Eligibility

A Student shall become eligible for certification only upon successful completion of all applicable requirements, including: completion of prescribed course duration, fulfilment of attendance requirements, successful completion of assessments, payment of all applicable fees, submission of required assignments, compliance with disciplinary requirements, and satisfaction of any additional eligibility criteria. Failure to satisfy any of the above may result in withholding or non-issuance of certification.

7.11 Nature of Certification

Certificates issued by the Institution represent successful completion of the prescribed academic requirements of the relevant course. Unless expressly stated otherwise, such certificates: are educational certifications issued by the Institution, do not constitute a professional licence, do not confer statutory recognition, do not authorize practice of any profession regulated by law, and do not guarantee employment, placement, client acquisition, or income.

7.12 Certificate Issuance

Certificates may be issued in digital format, printed format, electronic verification format, or any other format determined by the Institution. The Institution reserves the right to verify identity prior to issuance of any certificate.

7.13 Withholding of Certification

The Institution may withhold, suspend, or refuse issuance of any certificate where: fees remain outstanding, academic requirements are incomplete, attendance criteria are not fulfilled, misconduct is established, fraudulent documents have been submitted, there is misuse of the Institution's intellectual property, or any material breach of these Terms has occurred.

7.14 Duplicate Certificates

Requests for duplicate certificates, transcripts, verification letters, or replacement documents may be considered subject to: submission of a written application, verification of identity, and payment of applicable administrative charges. The Institution reserves the right to refuse issuance where fraud or misuse is suspected.

7.15 Certificate Verification

Employers, educational institutions, recruiters, government authorities, and other authorized organizations may verify certificates directly with the Institution through the prescribed verification process. The Institution reserves the right to levy verification charges where applicable.

7.16 Misuse of Certificates

Students shall not: alter certificates, forge certificates, misrepresent academic achievements, use certificates for unlawful purposes, or claim qualifications not actually awarded. Any such act may result in: cancellation of certification, blacklisting, reporting to relevant authorities, and initiation of appropriate legal proceedings.

7.17 Reservation of Academic Rights

The Institution reserves the right to modify attendance requirements, revise assessment methodology, change examination schedules, amend grading criteria, introduce new evaluation methods, update certification requirements, or revise academic policies whenever considered necessary. Any such changes shall apply prospectively.

PLACEMENT ASSISTANCE & FIT STREET PLATFORM TERMS

8.1 Nature of Placement Assistance

Fit Street National School of Health & Performance Sciences is committed to supporting eligible Students in their professional growth by providing Placement Assistance through various career support initiatives, including the Company's proprietary platform, FitStreet.in. Placement Assistance is intended to facilitate professional visibility and opportunities and shall not be construed as a guarantee of employment, clients, business, bookings, or income.

8.2 Scope of Placement Assistance

Subject to eligibility criteria prescribed by the Institution, Placement Assistance may include one or more of the following: profile creation, profile verification, profile activation on FitStreet.in, profile visibility to prospective users, resume building guidance, interview preparation, career counselling, networking opportunities, employer introductions, recruitment drives, industry connect programs, internship opportunities, or other support initiatives. The Institution reserves the absolute right to modify, discontinue, add, or replace any Placement Assistance service without prior notice.

8.3 Eligibility for Placement Assistance

Placement Assistance shall be available only to Students who satisfy all applicable eligibility requirements, including: successful completion of the course, fulfilment of attendance requirements, successful completion of assessments, compliance with institutional policies, payment of all applicable fees, submission of required documents, and profile verification. The Institution may prescribe additional criteria for specific programs.

8.4 FitStreet Platform

Placement Assistance shall primarily be facilitated through the Company's proprietary digital marketplace available at FitStreet.in. FitStreet.in is a technology-enabled marketplace that enables eligible professionals to create verified professional profiles for visibility before prospective clients and users. The Platform is designed to facilitate professional discovery and is not an employment agency, recruitment consultancy, staffing agency, manpower provider, or employer.

8.5 Profile Activation

Where applicable, eligible Students may receive profile activation on FitStreet.in after completion of the Institution's onboarding and verification process. Profile activation may include: professional profile listing, display of qualifications/certifications, specialization, service availability, geographic preferences, or other approved information. Profile activation shall not create any contractual relationship between the Student and prospective clients.

8.6 Marketplace & Demand-Based Model

The Student expressly acknowledges that FitStreet.in operates solely as a marketplace and demand-based platform. Availability of opportunities depends upon numerous commercial and market-driven factors, including: consumer demand, geographic location, service availability, client preferences, pricing, ratings/reviews, profile completeness, experience, competition, seasonal demand, market conditions, platform activity, and user engagement. The Institution does not guarantee that every listed profile shall receive equal visibility or identical commercial opportunities.

8.7 No Employment Guarantee

Enrollment in any course shall not guarantee: employment, job offers, interview calls, campus placement, recruitment, internship opportunities, employer selection, or appointment letters. The Institution shall use reasonable efforts to provide career support but shall not be liable if employment opportunities are unavailable.

8.8 No Client or Booking Guarantee

The Institution expressly clarifies that profile activation on FitStreet.in does not guarantee: personal training clients, nutrition consultation clients, online coaching clients, offline coaching assignments, gym partnerships, corporate assignments, sports team assignments, individual consultations, home training bookings, repeat customers, or any minimum number of enquiries or bookings. All bookings depend entirely upon independent decisions made by platform users.

8.9 No Income Guarantee

The Institution makes no representation, warranty, assurance, or guarantee regarding: minimum earnings, monthly/annual income, business revenue, financial success, return on investment, profitability, client acquisition rate, or career growth. Individual earnings, if any, depend upon numerous independent factors beyond the Institution's control.

Any earnings shown in advertisements, testimonials, case studies, promotional material, webinars, seminars, or social media content are illustrative in nature and shall not be construed as typical or guaranteed results.

8.10 Professional Responsibility

Students shall be solely responsible for: maintaining professional conduct, delivering services to clients, fixing pricing, managing schedules, maintaining licenses/insurance where required, complying with applicable laws, paying taxes, and maintaining professional standards. The Institution shall not supervise or control the independent professional activities of Students.

8.11 Client Relationship

Any relationship established between a Student and a client through FitStreet.in shall remain solely between those parties. The Institution shall not be liable for: quality of services rendered, client disputes, non-payment by clients, cancellation of bookings, professional negligence, personal injury claims, property damage, tax obligations, or contractual disputes.

8.12 Suspension or Removal of Profile

The Institution reserves the right to suspend, deactivate, restrict, or permanently remove any profile from FitStreet.in where: false information is submitted, misconduct is established, customer complaints are received, fraudulent activity is suspected, institutional policies are violated, fees remain unpaid, or continued listing is considered detrimental to the reputation of the Platform. Such removal shall not entitle the Student to any refund, compensation, or damages.

8.13 Platform Availability

The Institution shall make reasonable efforts to maintain availability of FitStreet.in. However, uninterrupted availability is not guaranteed. The Platform may experience downtime due to maintenance, software upgrades, security incidents, server failures, third-party outages, or force majeure events. Such interruptions shall not constitute a breach of these Terms.

8.14 Independent Contractor Status

Students using FitStreet.in acknowledge that they operate as independent professionals. Nothing contained in these Terms shall be interpreted as creating an employer-employee relationship, agency, partnership, joint venture, franchise, or principal-agent relationship between the Institution and any Student.

8.15 Limitation of Placement Assistance

Placement Assistance shall be deemed fulfilled upon the Institution providing one or more of the following: career guidance, resume support, profile verification, profile activation, profile visibility, access to placement opportunities, employer introductions, or recruitment support initiatives. The Institution shall not be responsible for outcomes beyond these assistance services.

8.16 Reservation of Rights

The Institution reserves the right to: modify placement policies, change eligibility criteria, update Platform features, introduce new placement models, discontinue placement initiatives, modify visibility algorithms, add/remove partners, or introduce premium services. Such changes shall not give rise to any claim for refund, compensation, or damages.

NO INCOME, EMPLOYMENT & RESULTS GUARANTEE

9.1 Nature of Educational Services

Fit Street National School of Health & Performance Sciences is an educational and skill-development institution. The Institution provides learning programs, certifications, career guidance, and placement assistance designed to enhance a Student's knowledge, skills, and professional opportunities. The Institution does not sell employment, business opportunities, or guaranteed financial outcomes.

9.2 No Employment Guarantee

Enrollment in any course, certification, diploma, internship, workshop, seminar, mentorship program, or educational service offered by the Institution shall not constitute or be interpreted as a guarantee of employment. The Institution does not guarantee employment, job offers, appointment letters, campus placements, recruitment, internship opportunities, employer selection, interview calls, or selection by any third-party organization. Any employment depends upon individual performance, credentials, and market demands.

9.3 No Income Guarantee

The Institution makes no representation, warranty, assurance, or guarantee regarding: minimum/maximum income, monthly/annual earnings, business revenue, profitability, financial success, return on investment, client acquisition, number of bookings, business growth, or any specific financial outcome. The Institution expressly disclaims any promise that a Student will earn any particular amount after completion of a course.

9.4 FitStreet.in Marketplace Model

Placement Assistance provided by the Institution is primarily facilitated through the Company's proprietary platform, FitStreet.in, wherever applicable. FitStreet.in operates solely as a technology-enabled marketplace and demand-driven platform connecting eligible professionals with prospective users. The Platform does not guarantee visibility to every user, equal exposure, client enquiries, personal training bookings, nutrition consultations, business opportunities, regular work, repeat customers, or commercial success.

9.5 Placement Assistance Does Not Guarantee Results

Placement Assistance is intended solely to improve career opportunities and professional visibility. It shall not be interpreted as a contractual promise that the Student will obtain employment, receive interview calls, acquire clients, secure projects, generate business, earn income, or recover course fees through professional practice.

9.6 Success Depends on Individual Factors

The Student acknowledges that professional success depends upon numerous independent factors including: individual knowledge, communication skills, practical ability, experience, professional conduct, client satisfaction, geographic location, pricing, competition, market demand, economic conditions, personal effort, and other factors beyond the Institution's control.

9.7 Testimonials & Promotional Material

Any testimonials, success stories, reviews, social media content, case studies, earnings illustrations, placement stories, or promotional material published by the Institution represent individual experiences only. Such material is illustrative, does not constitute a guarantee, shall not create any contractual obligation, and shall not be interpreted as typical results likely to be achieved by every Student. Individual outcomes may vary significantly.

9.8 No Business Guarantee

The Institution does not guarantee that completion of any program will enable the Student to establish a successful business, generate clients, build a profitable practice, obtain recurring customers, or achieve commercial success. Business outcomes remain solely dependent upon the Student's independent efforts and prevailing market conditions.

9.9 No Refund Based on Outcomes

The Student expressly agrees that dissatisfaction arising from: lack of employment, lack of clients, lack of bookings, low income, business failure, slower-than-expected career growth, personal expectations not being achieved, or any commercial outcome, shall not constitute grounds for cancellation, refund, compensation, damages, or any financial claim against the Institution.

9.10 Independent Professional Responsibility

Students are solely responsible for: obtaining clients, maintaining professional standards, marketing their services, negotiating commercial terms, managing their professional practice, complying with applicable laws, paying taxes, and maintaining required registrations. The Institution shall not supervise or control the Student's independent professional activities after completion of the course.

9.11 No Fiduciary Relationship

Nothing contained in these Terms shall be construed as creating any fiduciary, employment, partnership, agency, franchise, or joint venture relationship between the Institution and the Student by virtue of enrollment, certification, profile activation, or placement assistance.

9.12 Acknowledgement by Student

By enrolling in any course offered by the Institution, the Student expressly acknowledges and agrees that:

  • The Institution is providing educational services and career support only.
  • No promise or guarantee has been made regarding employment, client acquisition, bookings, earnings, or financial success.
  • The Student has enrolled after independent evaluation and has not relied upon any inconsistent representations.
  • Professional and financial outcomes depend primarily upon individual efforts, qualifications, and external market conditions.
  • The Institution's responsibility shall be limited to providing the support services described in these Terms.

STUDENT RESPONSIBILITIES & CODE OF CONDUCT

10.1 General Responsibility

Every Student shall conduct themselves in a professional, ethical, respectful, and responsible manner while interacting with the Institution, its faculty, staff, mentors, students, partners, employers, clients, and any person associated with the Institution. The Student shall uphold the values of integrity, professionalism, discipline, and mutual respect throughout the duration of their association.

10.2 Compliance with Institutional Policies

The Student agrees to comply with: these Terms & Conditions, Privacy Policy, Refund Policy, Placement Assistance Policy, Academic Policies, Examination Rules, Usage Guidelines, Community Guidelines, and all lawful instructions issued by the Institution from time to time. Ignorance of any policy shall not constitute a valid defence.

10.3 Accurate Information

Students shall ensure that all information submitted to the Institution is true, complete, accurate, and up to date. Students shall immediately notify the Institution of any change in: name, address, contact numbers, email address, educational/professional credentials, and identity documents. Providing false or misleading information may result in disciplinary action, suspension, cancellation of enrollment, or legal proceedings.

10.4 Academic Integrity

Students shall maintain honesty and integrity in all academic activities. Students shall not: plagiarize assignments, copy examination answers, impersonate another candidate, submit another person's work, use unauthorized assistance, manipulate academic records, falsify attendance, or misrepresent qualifications. The Institution reserves the right to take disciplinary action for any academic misconduct.

10.5 Respectful Conduct

Students shall maintain respectful and professional behaviour towards faculty members, mentors, administrative staff, guest speakers, placement partners, employers, recruiters, fellow students, clients, and website users. Abusive, threatening, intimidating, discriminatory, defamatory, or offensive conduct shall not be tolerated.

10.6 Prohibited Conduct

Students shall not engage in any activity that may adversely affect the Institution or any person associated with it, including: harassment or bullying, threats or intimidation, hate speech, physical or verbal abuse, sexual harassment, stalking, defamation, extortion, fraud, misrepresentation, unauthorized recording, distribution of confidential information, unauthorized use of branding, disruption of academic activities, posting misleading information, creating fake reviews, or any unlawful conduct.

10.7 Classroom & Online Behaviour

Students attending online or offline sessions shall: join sessions on time, maintain appropriate decorum, follow faculty instructions, participate respectfully, avoid unnecessary interruptions, and keep communication professional. The Institution may remove any Student from a session if their behaviour disrupts the learning environment.

10.8 Use of Digital Platforms

Students shall use the Institution's websites, LMS, applications, and digital platforms only for lawful educational purposes. Students shall not: attempt unauthorized access, introduce malware, share login credentials, circumvent security, scrape or copy platform data, interfere with platform functionality, or upload unlawful content.

10.9 Intellectual Property

Students shall respect the Institution's Intellectual Property Rights. Students shall not: copy course material, record lectures without written permission, redistribute study material, upload course content to public platforms, sell or commercially exploit resources, or remove copyright notices. All educational content remains the exclusive property of Ball Street Private Limited or its licensors.

10.10 Confidentiality

Students may gain access to confidential information relating to course material, business methodologies, faculty discussions, internal documents, research material, platform features, or other Students. Students shall maintain confidentiality and shall not disclose or misuse such information without written authorization. This obligation shall survive completion or termination.

10.11 Professional Conduct During Placement Assistance

Students participating in Placement Assistance or using FitStreet.in shall: maintain professional behaviour, provide accurate profile information, honour commitments made to employers or clients, deliver services ethically, and maintain applicable professional standards. The Institution shall not be responsible for disputes arising between Students and third parties.

10.12 Social Media & Public Communication

Students shall exercise responsibility while making public statements. Students shall not knowingly publish false, misleading, defamatory, malicious, or confidential information regarding the Institution, faculty, employees, students, partners, or affiliates. Nothing restricts a Student from making truthful statements or reporting concerns to authorities where permitted by law.

10.13 Compliance with Law

Students shall comply with all applicable laws of India while using the Institution's services. Any unlawful activity may result in: suspension, cancellation of enrollment, withholding of certification, removal from FitStreet.in, reporting to competent authorities, and appropriate legal action.

10.14 Disciplinary Action

Without prejudice to any other rights available under law, the Institution may take one or more of the following actions where a Student violates these Terms: issue a written warning, suspend platform/class access, cancel examinations, withhold certificates where legally permissible, suspend placement assistance, remove the Student from FitStreet.in, terminate enrollment, recover losses, or initiate legal proceedings. The action depends on the seriousness of the violation.

10.15 Duty to Protect Institutional Reputation

Students shall refrain from any deliberate act intended to unlawfully damage the goodwill, reputation, intellectual property, confidential information, or legitimate business interests of the Institution. This clause shall not prevent Students from exercising rights, including making bona fide complaints to competent authorities.

10.16 Acknowledgement

By enrolling in any program offered by the Institution, the Student acknowledges that they have read, understood, and agreed to comply with this Code of Conduct. Failure to comply may result in disciplinary or legal action, in addition to any other remedies available under these Terms or applicable law.

INTELLECTUAL PROPERTY RIGHTS

11.1 Ownership of Intellectual Property

All Intellectual Property Rights relating to the Institution, its courses, educational content, technology, branding, digital assets, and business methodologies are and shall remain the sole and exclusive property of Ball Street Private Limited or its respective licensors. This licence does not permit any commercial exploitation or transfer of rights.

11.4 Restrictions on Use

Without prior written authorization, no Student or User shall directly or indirectly: copy, reproduce, publish, modify, adapt, record, screen-record, redistribute, sell, rent, license, sub-license, commercially exploit, reverse engineer, decompile, disassemble, or create derivative works from any Intellectual Property belonging to the Institution.

11.5 Recording of Classes

Students shall not record, photograph, screen-record, audio-record, livestream, reproduce, or distribute any live classes, workshops, mentorship sessions, practical demonstrations, faculty presentations, or doubt sessions without obtaining prior written permission. Any unauthorized recording shall constitute a material breach of these Terms.

11.6 Distribution of Study Material

Students shall not share any study material with any third party through WhatsApp, Telegram, Google Drive, Dropbox, email, social media, cloud storage, torrent platforms, educational forums, or AI training platforms. This restriction applies irrespective of whether the sharing is free or for commercial consideration.

11.7 AI & Machine Learning Restrictions

Students and Users shall not use any course content, videos, study material, lectures, assessments, datasets, images, audio recordings, or proprietary educational material for: training Artificial Intelligence Models, Large Language Models (LLMs), Machine Learning Systems, Generative AI Platforms, or automated educational platforms, without the Institution's prior written consent.

11.8 Trademark Protection

The following, including any future variants, logos, stylized representations, slogans, and branding elements, are proprietary assets of the Company: Ball Street®, Fit Street®, Fitstreet.in, Fit Street National School of Health & Performance Sciences, Nutrition Intelligence™, NI™, domain names, and brand identity. No Student or third party shall use these marks without prior written authorization.

11.9 User-Generated Content

Where Students upload assignments, projects, testimonials, feedback, photographs, or videos, the Student confirms that they possess the necessary rights and that the content does not infringe any third-party rights. The Student grants the Institution a worldwide, royalty-free, non-exclusive, transferable licence to use, reproduce, display, publish, and distribute such content for academic administration, quality assurance, promotional, educational, research, and business purposes.

11.10 Feedback

Any suggestions, recommendations, ideas, improvements, feedback, or proposals voluntarily submitted to the Institution may be used by the Institution without any obligation to provide compensation, royalty, acknowledgment, or ownership rights to the Student.

11.11 Monitoring & Enforcement

The Institution reserves the right to monitor the use of its educational resources, digital platforms, and learning systems for the purpose of protecting its Intellectual Property Rights. Where unauthorized use, copying, distribution, or infringement is reasonably suspected, the Institution may investigate the matter and take appropriate action.

11.12 Consequences of Infringement

11.13 Survival

The obligations contained in this Section shall survive completion of the course, expiry of course access, cancellation of enrollment, suspension, termination of services, and any other cessation of the relationship between the Student and the Institution.

11.14 Reservation of Rights

All Intellectual Property Rights not expressly licensed under these Terms are reserved exclusively by Ball Street Private Limited. Nothing contained herein shall be interpreted as granting any implied licence, ownership interest, assignment, partnership, or other proprietary right.

HEALTH, NUTRITION & MEDICAL DISCLAIMER
